Phone mast appeal FAILS

Unfortunately Valerie Vaz has bad news on the mast appeal.

It has been refused as the court ruled it has no jurisdiction to allow an appeal. Valerie is awaiting to see a transcript of the case but her understanding is that the appeal judges were unsympathetic to the Council’s case.

Valerie will now look into with the Council if any further steps can be taken in this case. of course I will update further on any news.

Latest – Phone Mast Appeal

The last episode about the phone mast on Waverely Avenue is due tomorrow.

I have been informed by Valerie Vaz MP the following

This is to let you know that the first stage of Walsall MBC’s appeal against the Secretary of State’s decision will be heard at the Court of Appeal tomorrow at 10.30am before Lord Justice Pill, Lord Justice Sullivan and Lord Justice Tomlinson.

It has been listed for 2 days and Judgement may not be handed down immediately after the hearing.

We should remind ourselves the background is that the mast application was refused by 2nd class post but the phone mast operator say they did not receive the notice in time. The council say that the rejection was placed on their website and that constitutes public notification.

At this stage the council have lost all previous legal debate.

Snow update on Pheasey – Barr Beacon CLOSED Tues

Weather is getting better now in that no further snow forecast. Been out and the roads are passable on the estate but not great. Take care out there and especially tonight with temperatures predicted to be -5C.

Walsall Council finally got back about the gritting and pointed me towards THIS SITE run by volunteers. Go to Pheasey and note the high priority roads are Beacon Road, Collingwood Drive and Queslett Road.

I have received nothing back from the councillors as of this moment and I have to say where Hillingford Road, Romney Road and Wimperis Way are not high priority given the steepness of the hills is rather bemusing.

These roads are medium priority and they were certainly not down this morning when I went out. Also Collingwood is of the highest priority, that hardly looked gritted at all. It seems however side roads in Aldridge were done today, why is Pheasey left out ?

The answer to that may be self evident to many of us who live here.

From what I have heard all the schools will be open tomorrow which is good news.

Buses also appear to back to normal with the 997 and 5 running a normal service through the estate.

As for the Bin Collection the details can be found HERE for tomorrow’s collections. I would say a lot of us will be missed out.

Also would it not be a good idea for Walsall to copy Sandwell and get Snow Champions sorted. I cleared most of where I live but would be great if people did it around the area.

Due to continuing snowfall, school will be closed to students and staff tomorrow (Tuesday 22nd January) except for those taking exams.

I am surprised at this news as it is not too bad out there and teachers would be able to get in

Snow disruption in Pheasey

Another large snowfall today and just went for a walk and the place looks really beautiful in white.

We have heard that Meadowview and Barr Beacon schools are closed, no news on Pheasey Paark Farm. However looking around every other local school, Sandwell, Birmingham and Aldridge are closed so expect Pheasey to follow.

However the gritting operation around here is very poor. No gritters on Hillingford nor Collingwood and this is very poor by Walsall Council. I do not even think that they have been out at all on roads used by buses and very dangerous on hills.

I should add that I have tweeted Walsall Council a few times today and no reply to the gritting question. I was in Dudley earlier today and all their side roads are done never mind the major bus routes like we have. If you are due to catch a bus I would suggest go and catch one on the Queslett Road stops tomorrow.

Poor communication from Pheasey Park Farm as nothing heard. Can only presume make a call first thing tomorrow but every single school close to us has been closed.

Been snowing now for more than 14 hours continuously and cleared car only two hours ago and already covered. Lets hope they actually decide to grit the estate this time.

I have sent an Email to the councillors asking them for details and will put any answer on the site when I get it.

Pheasey Park Farm as you will now know is shut and no buses on the Estate yet and appears little gritting.

Great Barr Update and Isolation of Nether Hall

Apologies for the lack of updates recently but I am now working in London so my time is now rather limited. I obviously still take a close interest in the ongoing discussion about Great Barr Hall and note with interest the piece in last week’s Observer.

We do have a comment from a local Councillor in Adrian Andrew welcoming the discussions and in general the plans as we know them. However I do also note in the same piece there is again no discussion on how the building works will be paid for, that is the crucial point. Approaches to the new owners have failed to answer the question so we wait and see for the planning proposals to be submitted.

I did get excited (yep, thats the type of life I lead !!) when I saw a planning application for the area (12/1486/FL) but on inspection this is only about changing the building types for the third phase of the development (running at the back of Park Farm Road).

However on a previous blog the piece below was posted by a Nether Hall Resident and I believe it requires a wider viewing.

He/She raises two points which I will discuss after the quote.

As a Nether Hall Resident I look at any promises by any development company with a sense of huge skepticism. Bovis Home sold to the local populace and especially people like me who bought a home on the estate that there would be huge amounts of renovation to the parkland. 5 years ago we would told that in no time at all we would be able so cycle or walk around woodland over the whole estate, enjoy the restored walled gardens, brooks, streams etc. By the end of 2012 we have a bit of lawn in the centre of the development and a sometimes open, always scary portal into the parkland where you soon come face to face with friendly dobermans guarding the hall. We were also all assured that the local infrastructure would support the development but there are no new schools, doctors or shops.

To make it clear though at the moment Nether Hall residents are not expected to pay any management costs.

I cannot see how the enabling work will either lead to a) the funds to maintain the hall or b) improve (and importantly secure) the parkland around. I also cannot see how the area can support another 40 to 100 new families?!?

On the first point I totally agree. The people on Nether Hall have been totally let down by Bovis in many ways. The environment is frankly bad for people to live with slowed up developlments. I am aware also the quality of the finishing to the housing. On top on this frankly the relationship between the residents on Nether Hall and the rest of Pheasey is non existent.

We do share the same political boundaries, we do share the same facilities and have to live in the same space as each other. It would be great to have better community cohesion but I fear there are too many obstacles to that.

On the second point as mentioned above we are all in the dark on how this will be paid for. The pieces in the Observer have been very soft and almost a PR release. It is only when we have the full plans laid in front of us any of us can judge. By now it would be good for the owners to come out with a public statement on how they will pay for it.

The Great Barr Hall Consultation

As I posted a couple of days as I was not able to go so grateful to Margaret for this reply on another thread.

Attended this evenings consultation@ Collingwood centre. A slick presentation by the architects. Good luck to the owners & developers in their endeavours to make ‘a silk purse from a sow’s ear’
Well, it appears that further housing will be included in this development, I sense an exclusive & secured estate.The present owners have quite rightly secured the area to discourage undesirables & their unsociable activities but from personal observation, I have noted evidence of ‘drinking dens’
near the entrance to the Nether Hall Estate (the problems do not go away, they crop up elsewhere)
I sincerely trust that the new development turns out to be all that’s hoped for, unlike the Bovis estate ( if ever there was a case for ‘Rogue Traders’ this is one) We learned tonight, that the residents of Nether Hall will be paying a management fee for upkeep of the area, presumably this is in addition to council tax. I wonder who this will be paid to as I’ve been informed that Bovis no longer own the woodland adjoining Park Farm/Foxwood Avenue.My enquiries to both Walsall council, local councillors & Bovis have proved fruitless.So, who do Nether Hall & Park Farm residents refer to when they have issues?

So some points

Nether Hall has not been adopted by the Council so any upkeep on roads etc is now to the residents there.

As for the woodland any ownership of this land should be seen in the Land Registry lists. The local council and councillors should be aware of this and I am disappointed no response was received.

Then you have the big issue, the issue that is well known. The only way to restore the area with out public money is through the building of housing. that will be the debate as we move on and I am sure it will inflame views.

In my view I see no alternative to some building on there to preserve the land, there will be no public money for this. So the choice then becomes stark.

Great Barr Hall Consultations are this week.

It was buried away a bit in the Great Barr Observer but the promised consultation by Lapworth are this week.

There is one showing on Monday 12th at the Colingwood Centre 16:30 – 20:00

A second showing on November 15th at the Holiday Inn Hotel from 09:00 – 13:00

I would have loved to have gone but unfortunately a new job makes this impossible. I would have liked to see a presentation run at the Weekend for those of us with jobs and ask that Lapworth could run one then.
